Resolution

Be it resolved, that any violation of a valid court order with child possession orders in the State of Texas, occurring more than 2 times, and falling under the Texas Penal Code 25.03, shall require a fine of no less than $5000 be paid to the other parent.

Be it resolved, that no agency or entity in the State of Texas shall receive any Title IV-D funding, unless first, one parent has either, by a court or jury of competent jurisdiction, been found unfit by clear and convincing evidence, or has been presented with 50% possession time and is unwilling to exercise this time with his/her children.

Be it resolved, that the Texas Family Code be amended to provide children with equal access and possession times to BOTH parents unless one or both parents have been shown through clear and convincing evidence to be harmful to his/her children.  This resolution changes the standard of review for the court to consider when determining possession and access, other than equal times.

Be it resolved, that the Supreme Court decision in Troxel v. Granville be codified in the Texas Family Code.  Succinctly put, there is a presumption that fit parents act in the best interests of their children. So long as the parent is fit, there will normally be no reason for the State to interject in the private realm of the family to question the ability of that parent to make the best decisions concerning the rearing of that child.

  1. When will or are these resolutions active?
    My child was abducted, a court ordered of final and a caregiver agreement attained with no hearings and in perjury stopped me now for 6 months from getting back my 9 year old

    My child was also authorized for employement by the caregiver agreement.

    No trials and no hearings.

    He’s with grandparents who abducted him.
